Support & Updates Policy

This Support & Updates Policy describes the general support, maintenance, and update practices for EMP Intake provided by Falcrex Systems Inc ("Falcrex," "we," "us," or "our"). This Policy supplements the EMP Intake End User License Agreement ("EULA"), Privacy Policy, applicable order terms, Third-Party Notices, and any separate written support or subscription agreement between Falcrex and the customer.

If a separate signed agreement provides different support or update terms, the signed agreement controls to the extent of any conflict.

In plain English

A convenience summary of what this Policy below already says. The full Policy governs.

  • Email support. Standard support is by email at support@falcrex.com, on a reasonable-efforts basis. There is no guaranteed response time, SLA, or after-hours coverage unless you have that in writing.
  • Updates are at our discretion. Falcrex decides which versions stay supported and how changes ship. Some updates may be required for security, licensing, or compatibility.
  • Your backups are yours. You are responsible for backing up your case data and exports. Do not send live evidence through support unless we ask and you are authorized to share it.
  • Standalone by design. Troubleshooting generally uses descriptions, screenshots, and non-case-specific diagnostics. Do not send case files unless Falcrex requests them and you are legally authorized to share them.
§1

Scope

This Policy applies to:

  • EMP Intake desktop software;
  • related software updates, patches, bug fixes, release notes, and notices;
  • standard customer support communications; and
  • general product maintenance practices.

This Policy does not create a guaranteed service level agreement, response time commitment, uptime guarantee, or custom development obligation unless Falcrex expressly agrees to those terms in writing.

§2

Standard Support Channels

Standard support is generally provided through:

  • email support at support@falcrex.com;
  • release notes or product notices;
  • documentation, guides, FAQs, or legal notices made available by Falcrex; and
  • other support methods Falcrex may designate from time to time.

Falcrex may change support channels, procedures, or contact methods at any time.

For purchases through Paddle, use the support link in your Paddle receipt or https://paddle.net for billing, cancellation, or refund requests. Falcrex provides EMP technical and licensing support at support@falcrex.com. Refund eligibility and cancellation terms are described in section 6 and section 7 of the EMP Intake Terms of Service at https://empintake.com/terms#refunds.

§3

Support Hours and Response Expectations

Unless Falcrex has agreed otherwise in writing, support is provided on a reasonable-efforts basis during normal business operations.

Falcrex does not guarantee:

  • a specific response time;
  • a specific resolution time;
  • after-hours support;
  • weekend or holiday coverage; or
  • support for every custom environment, workflow, or third-party integration.

Any time estimates, target responses, or informal communications are non-binding unless expressly included in a written agreement.

§4

What Standard Support Generally Covers

Standard support may include, at Falcrex's discretion:

  • assistance with installation or activation issues;
  • licensing and subscription questions;
  • troubleshooting reproducible software issues;
  • help understanding documented features;
  • guidance on known workarounds; and
  • information about available updates, patches, notices, or release versions.
§5

What Standard Support Does Not Include

Unless separately agreed in writing, standard support does not include:

  • on-site support;
  • guaranteed response or resolution times;
  • custom development or feature implementation;
  • custom report design or custom workflow configuration;
  • recovery of lost data caused by customer environment, deletion, corruption, hardware failure, or unsupported third-party actions;
  • forensic, legal, regulatory, or investigative advice;
  • support for unsupported operating systems, altered installations, or unauthorized modifications; or
  • review, analysis, storage, or handling of live case files, evidence files, or sensitive investigative materials except where Falcrex expressly agrees in writing.
§6

Customer Responsibilities

To receive support, the customer is responsible for:

  • maintaining a valid license or authorized use of the Software;
  • using supported versions of the Software where reasonably practical;
  • providing accurate information about the issue;
  • cooperating with reasonable troubleshooting steps;
  • maintaining backups of all Customer Data and exports;
  • protecting account credentials, devices, and local environments; and
  • ensuring that any information shared with Falcrex is lawful to disclose.

Customers must not send live case records, evidence files, or sensitive investigative materials through support channels unless Falcrex specifically requests them and the customer is legally authorized to share them.

§7

Standalone Data and Troubleshooting

EMP Intake is designed primarily as a standalone desktop application.

In normal standalone use, most case records, files, metadata, and evidence remain on the customer's own device or storage environment unless the customer exports, syncs, submits, or shares that data through a separate service or support process.

Support and troubleshooting are therefore generally based on:

  • customer descriptions of issues;
  • screenshots;
  • logs or diagnostics voluntarily provided by the customer;
  • licensing information;
  • version and environment details; and
  • other non-case-specific technical information.
§8

Updates, Patches, and New Versions

Falcrex may release:

  • bug fixes;
  • patches;
  • maintenance releases;
  • security updates;
  • compatibility updates;
  • feature updates; and
  • new major or minor versions.

Falcrex may decide, at its discretion:

  • whether to develop or release any update;
  • which versions remain supported;
  • when to retire or discontinue older versions; and
  • whether a particular change is delivered as a patch, minor release, or major release.

Some updates may be required for security, licensing, compatibility, or continued support.

§9

Feature Changes and Product Evolution

Falcrex may add, change, improve, limit, suspend, or remove features, integrations, or functionality over time.

Unless Falcrex expressly agrees otherwise in writing, customers are not guaranteed:

  • that any specific feature will remain available forever;
  • that roadmap items or future features will be delivered; or
  • that all updates will be backward compatible with every external tool, workflow, or third-party dependency.
§10

Supported Versions

Falcrex may require customers to update to a more recent version before certain issues can be investigated or supported.

Falcrex may limit support for:

  • outdated versions;
  • end-of-life versions;
  • beta or preview releases;
  • altered or unofficial builds; or
  • installations running in unsupported environments.
§11

Third-Party Components and Services

EMP Intake may rely on or interact with third-party components or services, including licensing tools, map services, codecs, embedded databases, website services, email providers, or payment-related systems.

External service providers may include Cryptlex, Microsoft 365, Webflow, Cloudflare, and Paddle. EMP Intake WS map features use OpenStreetMap-derived Protomaps data delivered through a Falcrex-controlled map service using Cloudflare infrastructure. Locally bundled software components may include FFmpeg, SQLite, Font Awesome, and Electron; including a component does not mean Customer Data is sent to its developer. Current provider information is available at https://empintake.com/sub-processors and https://empintake.com/trust.

Falcrex is not responsible for outages, changes, restrictions, attribution requirements, or policy decisions made by third-party providers, though Falcrex may use reasonable efforts to work around them where practical.

Applicable third-party terms, notices, and attribution requirements may also be described in a separate THIRD-PARTY-NOTICES file distributed with the Software.

§12

Backups and Data Protection

Customers are solely responsible for:

  • backing up Customer Data;
  • protecting exported files and evidence;
  • verifying retention settings;
  • testing restore procedures where appropriate; and
  • maintaining appropriate local security, storage, and recovery practices.

Unless Falcrex expressly provides a separate paid backup or hosted service in writing, Falcrex does not undertake responsibility for maintaining customer backups.

§13

Suspension or Refusal of Support

Falcrex may refuse, limit, or suspend support where:

  • the request involves unlawful activity;
  • the customer is abusive, threatening, or fraudulent;
  • the Software has been modified without authorization;
  • the environment is unsupported;
  • required fees remain unpaid; or
  • providing support would create unreasonable legal, security, privacy, or operational risk.
§14

No Legal or Investigative Advice

Support provided by Falcrex is technical and product-related only.

Falcrex does not provide legal advice, forensic conclusions, HR advice, investigative conclusions, regulatory guidance, or any guarantee that a particular workflow, report, export, evidence handling practice, or third-party integration will satisfy any legal or professional standard.

§15

Changes to This Policy

Falcrex may update this Policy from time to time. The updated version will be posted or otherwise made available with a revised "Last Updated" date.
